§1 General Provisions 

1. These Terms and Conditions define the rules for using the mobile tourist and historical application “Mikołów” (hereinafter: the “Application”), which serves as an audio guide for providing visitors to the city of Mikołów with information about tourist attractions.
2. The developer of the Application is Audiotour Michał Krynicki, pl. Jana Kilińskiego 2, 35-005 Rzeszów, email: mkrynicki@audiotour.pl.
3. The Application has been developed on behalf of the Municipality of Mikołów.
4. The Application may be used on mobile devices running Android version at least 14.0 and iOS version at least 14.0. The Application is available for respective operating systems via Google Play and the App Store.
5. Use of the Application is free of charge.

§2 Application Functionality 

1. The Application is available in two language versions: Polish and English.
2. The Application enables, in particular:
   • viewing points of interest in the city of Mikołów from a tourist and historical perspective, including descriptions, photographs, assigned categories, and map locations;
   • listening to audio recordings for each location or object;
   • participating in audio tours in versions for adults and children;
   • searching for objects by name;
   • participating in a field game;
   • determining a route.
3. Certain features of the Application may require:
   • an Internet connection;
   • location services enabled on the mobile device.

§3 User Data and Privacy 

1. Use of the Application does not require creating a user account or providing personal data.
2. The Application may use the device’s location services solely to display the user’s current position on the map.
3. Location data is not stored or processed by the developer.
4. The Application uses external services, such as Google Maps, which may process data in accordance with their own privacy policies. 

§4 Rules of the Field Game 

1. The organizer of the educational field game titled “Utracone” is the City Hall of Mikołów, with its registered office at Rynek 16, 43-190 Mikołów.
2. The purpose of the game is to discover historical locations in the city of Mikołów and collect virtual stamps of visited places.
3. Participation in the game is free of charge.
4. The game is intended for users of all ages.
5. During the game, participants move along the route on foot, as the pace of voice instructions is adapted to walking speed.
6. The participant’s tasks include:
   • completing the route according to the instructions provided in the Application;
   • answering quiz questions included in the Application, whereby incorrect answers do not prevent completion of the game.
7. After completing the game, participants may contact the Promotion Office of the City Hall of Mikołów to collect a symbolic prize. Contact: email: promocja@mikolow.eu, tel. +48 32 32 48 549.
8. During the game, participants must strictly comply with traffic regulations.
9. Participants move around the city at their own responsibility.
10. The organizer does not provide medical care for participants.
11. The organizer shall not be liable for participants’ actions during the use of the game.

§5 Liability 

1. The information presented in the Application is for informational and tourist purposes only.
2. The developer makes reasonable efforts to ensure that the information is current and accurate.
3. The developer shall not be liable for:
4. errors in maps or external services;
5. problems resulting from lack of Internet access; 3. malfunction of the Application caused by the user’s device settings.

§6 Copyright 

1. The selection and arrangement of content available in the Application constitute works within the meaning of the Act of 4 February 1994 on Copyright and Related Rights and are protected under applicable law.
2. Such protection also applies to all other works, trademarks, and elements included in the Application, in particular texts, photographs, and multimedia.
3. It is prohibited to copy or modify any part of the Application (including its source code), in whole or in part, or to use it in any manner other than specified in these Terms and Conditions.
4. The user is entitled to use the resources of the Application solely for personal use. Use of the Application for activities that would infringe the developer’s interests is not permitted.

§7 Final Provisions 

1. These Terms and Conditions may be amended in the event of updates to the Application or changes in its functionality.
2. Any comments, questions, or feedback regarding the Application may be sent to: biuro@audiotour.pl.
3. The current version of the Terms and Conditions is available within the Application.
4. Use of the Application constitutes acceptance of these Terms and Conditions.
